What should you know about trainer liability and insurance before sending your horse to training?

The liability and insurance landscape around horse training is something most horse owners do not investigate until something goes wrong, at which point the gaps in coverage and the ambiguities in liability can be costly and stressful. Understanding the basics before your horse goes into training prevents those surprises. Most professional trainers carry general liability insurance that covers them against claims arising from their professional activities — if a visitor to their facility is injured, for example, or if their actions directly cause harm to a horse in their care. What most trainers' liability insurance does not cover is the horse itself. If your horse is injured during training, becomes ill, or dies, the trainer's liability insurance typically does not compensate you for the horse's value or medical costs unless the trainer's negligence can be proven — which is legally difficult in the equine context. Horse mortality and major medical insurance is the owner's responsibility. If your horse has significant monetary or emotional value, insuring it before it goes into training is advisable — not because you expect something to go wrong, but because training does involve risk and insurance exists precisely for situations where the risk materializes unexpectedly. Many states have equine activity liability statutes that significantly limit trainers' and facility operators' legal liability for injuries to horses or riders, requiring participants to acknowledge and assume the inherent risks of equine activities. Most training contracts include these acknowledgments. Reading and understanding what you are signing — ideally with a brief review by an attorney familiar with equine law in your state — is worth the time before a dispute arises. Ask the trainer directly about their insurance coverage and what it does and does not cover. A professional trainer should be able to answer this question clearly and provide evidence of current coverage on request.
